  1. Preamble

The cooking schools of “La Cocina GmbH” in Hamburg, Hanover and Bremen (hereinafter all cooking schools are simply referred to as “La Cocina”) run cooking courses and cooking events for private and corporate customers at their respective locations in Hamburg, Hanover and Bremen. They both appear under the common brand name “La Cocina” and can therefore be reached together via the website www.lacocina.de. The cooking classes and cooking events are conducted under professional guidance. The company is managed by the managing director Dumecilia Kaeker. The latter reserves the right to delegate the management of individual events and cooking courses to employed chefs of “La Cocina” or external chefs. The cooking events are mainly organized by companies and tradesmen for employees, customers or for promotional purposes. The cooking classes are made up mostly of free participants who sign up to attend individually or in small groups. The following conditions regulate the details of booking cooking courses and cooking events as well as questions of implementation and liability.

  1. Registration and booking

When registering and booking, a distinction must be made between cooking events commissioned by companies and private individuals and participation by private individuals in cooking courses. La Cocina is entitled to freely determine the course location or the event area at any time for private individuals and corporate customers for operational reasons.

  1. a) Booking of cooking events In the case of cooking events, the interested party must specifically inform “La Cocina” of the type, scope and special design requirements. The notification shall be made in writing. The notification via e-mail is sufficient. Upon receipt of the information, the respective “La Cocina” will submit an offer regarding the type and costs of the desired event. The offer is binding for the respective “La Cocina” as a provider 7 days or until the option date agreed individually with the customer. The offer must be accepted in writing within this period. After the deadline the offer expires. A form other than the written form is not sufficient. Any dates for the implementation of the event provided for in the offer shall lose a binding effect. If the recipient of the offer accepts it within the deadline, the booking of the event with the number of participants registered by the recipient on the date specified in the booking is binding for both parties.

The invoices of “La Cocina” are due immediately, but at the latest within 30 days after receipt of the invoice by the customer.

  1. b) Booking of individual cooking courses

Booking of individual cooking courses can be done by phone or via the Internet through the cooking schools Internet portal https://www.lacocina.de. The locations are shown accordingly. The booking can also be made in the respective offices of “La Cocina” in Hamburg or Hanover. The booking of the user is to be understood as an offer to conclude a contract. The respective “La Cocina” decides after receipt of the

offer about its acceptance. A rejection of the offer must be made in particular if the courses are occupied or the required minimum number of participants is not reached.

Upon acceptance of the offer for the location by the respective “La Cocina”, the booking is considered binding. The acceptance or rejection of the offer will be made by “La Cocina” no later than 5 days before the start of the course.

  1. c) “La Cocina” payment methods

Cooking class bookings can be made in two different ways:

Booking by phone or booking on site: Cooking classes booked by phone can be paid on the evening of the event by ec-card, credit card (Visa, Mastercard) or cash.

Courses booked on site can also be paid by ec-card, credit card (Visa, Mastercard) or cash.

Online booking: Bookings via the online store at www.lacocina.de can be paid by PayPal, credit card (Visa, Mastercard), instant bank transfer or bank transfer (prepayment).

  1. d) Voucher

Our vouchers have the validity of three years from the date of issue. However, due to the unpredictable price developments of the market, the price commitment of the events is only valid for one year. Any additional payments will then be made on the course day itself.

Vouchers can be requested by telephone, in writing or by e-mail on the Internet at – Cooking Course Voucher. Payment for the vouchers must be made within 7 calendar days of issue.

Vouchers issued for a specific course are considered binding. For organizational reasons, rebookings, cancellations shorter than one week before the start of the course are not possible and will result in the loss of the voucher value. In case of no-show

this as well. There is no right to reimbursement. Transfer to other participants is possible with advance notice. A cash payment of voucher amounts or remittance of the same is generally excluded.

  1. Cancellations of cooking courses and cooking events

For cooking events (complete occupation of La Cocina or a partial area):

Cancellations made up to 30 days prior to the start of the cooking event are not subject to cancellation fees. For cancellations up to 14 days before the start of the cooking event, we charge a cancellation fee of 50% of the total amount of the event. For cancellations made less than 14 days prior to the start of the cooking event, we will charge a cancellation fee of 100% of the total amount of the event. This also means the inclusion of booked additional services.

For cooking classes (participation in a cooking class offered by La Cocina):

The cooking course participant has the possibility to cancel his booking free of charge until 7 days before the start of the cooking course! In the event of a successful cancellation, any tickets and vouchers paid in advance remain valid and can be redeemed in any other cooking course, provided the course takes place and there are still sufficient places available. Failure to comply with the cancellation deadline entitles “La Cocina” to charge the late canceling participant the full course fee. In case of no-show without valid cancellation, the ticket purchased in advance by the no-show participant will be forfeited.

In case of non-appearance of a participant who has not yet purchased a ticket in advance, the full course fee will be charged. The invoice will be sent to the non-attending participant in writing after the event. La Cocina Cooking Schools reserve the right to cancel cooking classes at least 7 days prior to the start of the cooking class due to low cooking class attendance. The voucher/ordered cooking course remains valid for one year from the date of the cooking course.

Only after the third cooking class cancellation in a row, you can ask for the money back for the cooking class – except you have purchased a merchandise voucher.

General

All cancellations must be made in writing.

If official regulations do not allow corona to hold an event, no cancellation costs will be incurred.

  1. Number of participants
  2. Number of participants for closed events (cooking events)

The final number of participants for closed events must be communicated in writing to the respective “La Cocina” up to 7 working days before the cooking event. If this does not occur or if the number of participants indicated is reduced by more than 20%, “La Cocina” will charge the amount indicated on

the number of participants indicated in the offer for the event invoice.

  1. Number of participants for cooking courses

If a cooking class does not reach a minimum of 10 participants, La Cocina has the right to cancel the cooking class. In this case, any tickets or vouchers purchased in advance retain their monetary value and can be redeemed in any other cooking course, provided the course takes place and there are still sufficient places available.

  1. Subject to changes in food preparation

For the implementation of cooking events and cooking classes, only high quality food

used. Consequently, the respective “La Cocina” must reserve the right in case of supply shortages also to use such foods that do not fit the theme of the cooking course. In this respect, the cooking program is subject to change.

  1. Course schedule

The course duration is about 4.5 hours. This time includes the introduction, preparation and cooking of the food and eating it together. After the 4.5 hours have elapsed, an overtime fee of € 20 net per person per hour or part thereof will be charged to cover personnel and beverage costs.

  1. Damage

Participation of the course participants is at their own risk. The liability of the respective “La Cocina” is limited to damages to life or limb, which are due to intent or gross negligence. Participants are liable according to the legal regulations for damages they cause in the premises of the respective “La Cocina”.

  1. Clothing

The participants themselves have to make sure that they wear appropriate clothes for cooking. Aprons are provided.

  1. Diseases

Due to the use of induction hotplates, problems with pacemakers may occur. In addition, it must be taken into account that there may be a not inconsiderable amount of heat generated by the cooking of the food due to the course.

  1. Vouchers

At the respective “La Cocina” can be purchased course vouchers or those with a certain value of goods. The validity of the vouchers is limited to three years from the date of issue. However, due to the unpredictable price developments of the market, the price commitment of the events is only valid for the year in which the respective voucher is issued. Any additional payments will then be made on the course day itself. Registration/redemption of the voucher is possible for any course, provided that the course is not yet fully booked and thus fully booked. The above statements apply to the binding nature of the registration. At the time of booking, the booker has to indicate the voucher no. Specify. The course is considered paid in full or in part only when the original voucher has been handed over to the respective issuing “La Cocina”. If the value of the voucher is lower than the market value, the amount must be settled in accordance with the invoice. If the voucher value exceeds the course value, the remaining amount can be applied to another course. Payment of the difference cannot be made.

  1. Transferability of bookings

Course bookings, if already paid for, may be transferred to third parties, provided they have not already booked the course in question themselves.
